President of Azerbaijan Ilham Aliyev has signed a decree approving amendments to the Law «On Aviation.»
The new amendments are aimed at improving the legislative framework governing the country’s civil aviation sector.
The text of the approved document has been published on the official website of the President of Azerbaijan.
According to the amendments, the rules for the use of the airspace and the operation of ultralight aircraft will be determined by the body (institution) designated by the relevant executive authority.
According to the document, the Cabinet of Ministers of the Republic of Azerbaijan must, within four months, prepare and submit to the President of the Republic of Azerbaijan its proposals related to establishing liability for violations of the requirements governing the use of the airspace and the operation of ultralight aircraft.
In addition, in accordance with Article 56.5 of the Law of the Republic of Azerbaijan «On Aviation,» the rules governing the use of the airspace and the operation of ultralight aircraft must be approved within three months, taking into account the proposals of the State Protection Service of the Republic of Azerbaijan, the Ministry of Digital Development and Transport of the Republic of Azerbaijan, the Ministry of Justice of the Republic of Azerbaijan, the Ministry of Youth and Sports of the Republic of Azerbaijan, the State Agency for the Protection of Strategic Facilities of the Republic of Azerbaijan, and the Tourism Agency of the Republic of Azerbaijan, after which the President of the Republic of Azerbaijan must be informed.
The rules must include the following:
• requirements for the technical specifications of aircraft;
• registration of aircraft and their operators, as well as cases in which registration is exempted;
• requirements regarding the age, training, medical fitness, and professional qualifications of persons operating aircraft, as well as the mechanism for providing them with documentation granting the right to operate an aircraft;
• criteria for the precise determination of areas where flights are permitted, restricted, or prohibited, including the regulation of flights over the state border, military facilities, strategic infrastructure facilities, airports, and other specially regulated zones;
• specific provisions governing the use of aircraft for commercial or non-commercial purposes, including personal, sports, and tourism activities;
• safety requirements, including prior coordination and notification procedures to ensure the safe conduct of flights;
• requirements concerning the technical airworthiness, operation, and periodic inspection of aircraft;
• the rights and responsibilities of aircraft operators and persons participating in flights.
